My mom wants to sell her msdn stuff as she isn't useing it becasue she got fired. We have estimated that she has about $3000 worth of software. But my step-dad sais that we can't sell it, he sais that the company that my mom worked at owns it. But this isn't a scenario where my mom checked out the software, the company actually gave her the software. but he still sais that we can't sell it. How can I figure out who owns it?

Did she have to sign anything when the company gave her the software, is there anything that says you can't sell it on the packaging?

If the subscription to MSDN is in her name (very common practice for companies it seems), then the software belongs to her, not the company. At least that's the way it worked where I used to work. We all had MSDN subs and when we got layed off, the MSDN subs came with us. Fun stuff. Since the company was paying though, mine has expired (but my roommate still works there.  ) |

I would guess that she cannot resell it. MSDN is a subscription, not purchasing of software.

If the company was paying for her MSDN subscription then they might not like that.
Microsoft prohibits reselling the software. We have one of the higher subscriptions to MSDN and it's plastered all over the software and the documentation. It's not retail software, it's development software that Microsoft provided with the MSDN.

the only documentation that comes with the software is a letter that sais what came in the box. What can the company do if they found out she is selling it? They gave it to her. |

No. She doesn't technically own the software.
We're getting into the finer details of Microsoft licensing. Purchase Windows (for example) gives you the "priviledge" of using Windows but MS still owns the software.
The same is true with the MSDN software. MS still owns the software.
They frown on their retail software being sold by anyone except themselves or authorized software resellers.
So having someone sell their beta CDs and development libraries could potentially lead to a lawsuit, if they wanted to.

Could we send it back to msdn and ask for our money back? |
