A Constitution CAN be AMENDED. | Schwarzenegger released the following statement on May 15, 2008 regarding the ruling: "I respect the Court's decision and as Governor, I will uphold its ruling. Also, as I have said in the past, I will not support an amendment to the constitution that would overturn this state Supreme Court ruling." So a little update is in order as of July 24th 2008.
New ballot label and summary for Proposition 8
On July 24, California Attorney General Jerry Brown changed the official ballot summary language of Proposition 8 Ballot Title: Eliminates Right of Same-Sex Couples to Marry.
Initiative Constitutional Amendment
Changes the summary, from:
Prop 8 - Amends the California Constitution to provide that only marriage between a man and a woman is valid or recognized in California.
to:
Prop 8 - Changes California Constitution to eliminate right of same-sex couples to marry. Provides that only a marriage between a man and a woman is valid or recognized in California.
Fiscal Impact: Over the next few years, potential revenue loss, mainly sales taxes, totaling in the several tens of millions of dollars, to state and local governments. In the long run, likely little fiscal impact to state and local governments. What was that popping noise? The brains of Dobson and the Pope (and any other jerk that wants to use a constitutional amendment to take rights away) just explode?
The new wording portrays accurately what is going on with the amendment proposed, which would add a new section (Section 7.5) to Article I, placing it between the state Equal Protection clause and nondiscrimination in business and the professions. This new section would read: Only marriage between a man and a woman is valid or recognized in California. LA Times report on this.
