"official oppression" instead of assault question.

Controversy Rages Over Houston Cop Beating Tape - The Early Show - CBS News

An explosive videotape that appears to show a group of Houston police officers beating a black teen burglary suspect last March has led to the firing and indictment of those officers, and a flaring controversy.

A surveillance camera caught the end of a police chase of 15-year-old Chad Holley, who had allegedly burglarizing a home.

Holley goes right to the ground, face-down, hands over his head, as if to surrender.

But then, reports CBS News correspondent Seth Doane, one officer appears to stomp on Holley's head, while others kick him. One cop seems to land five kicks. Then, another officer punches him again, and again. As he's picked up, there's another kick.

    --SNIP--

Four officers have been indicted, charged with "official oppression," a misdemeanor, not a felony. If convicted, each faces up to a year in jail and a $4,000 fine.
The officers kicked and beat a teenager had who surrendered, are charged with "official oppression," Can anyone tell me why it is "official oppression," and NOT assault(FELONY assault IMO) these officers are being charged with?

Officers should be punished. I don't think Official Oppression seems in keeping with what I saw on that video.

I do think a criminal should really consider not running from police. Get a bunch of guys chasing prey and piss them off by making them have to run and you may end up with a smack down. Group think is a dangerous thing, adreniline fed group think is even worse. I don't say this is a good thing nor should the cops be obsolved of wrong doing. But if you are a criminal you should really reconsider your decision to bolt like a prey animal. When they say halt just fricking halt.

As for the cops prey drive is not an excuse to skip out on humanity. If it was a murderer who had just slaughtered a class of preschoolers and shot your partner I might buy temporary insanity. But this guy just pissed you off and did not obey your. A rough knee to the back and over tight cuffs is really as far as I will defend.

    "Might"?!

As a defendant, I would NOT want you on my jury!

    Jasmine,

I would have to take it case by case.
