Thumbs down Hm, who do you believe?

The Insurance company, or the family of the accident victim?
Comedian Matt Fisher Claims Sister’s Progressive Insurance Paid for Her Killer’s Lawyers | Observer

Titled “My Sister Paid Progressive Insurance to Defend Her Killer In Court,” the story chronicles the increasingly insane behavior of Progressive to deny paying out the full amount after the sister, Katie, was killed by an under-insured driver 2010. While Progressive was due to pay the difference between Katie’s policy and the driver’s, instead they fought the case, leading Mr. Fisher’s family to realize a small state loophole:

In Maryland, you may not sue an insurance company when they refuse to fork over your money. Instead, what they had to do was sue the guy who killed my sister, establish his negligence in court, and then leverage that decision to force Progressive to pay the policy.

After doing so, Mr. Fisher realized that the man who ran into his sister’s car was being represented by lawyers that were paid for by Progressive, allegedly in an attempt to have the case thrown out, and dismiss the Fishers’ claims entirely. As Mr. Fisher claims:

If you are insured by Progressive, and they owe you money, they will defend your killer in court in order to not pay you your policy.

I’d like to take this opportunity to explain Progressive’s role in this complex case. First and foremost, our deepest sympathies go out to Kaitlynn Fisher’s family.

To be very clear, Progressive did not serve as the attorney for the defendant in this case. He was defended by his insurance company, Nationwide.

There was a question as to who was at fault, and a jury decided in the Fisher family’s favor just last week. We respect the verdict and now can continue to work with the Fisher family to reach a resolution.

That really is a nice side-step, "did not serve as the attorney" - the family SAID they paid for the attorney, NOT that they served as the attorneys!(am I wrong?)

I have known that insurance companies are nearly as sleazy as used car salesmen, I had no idea any of them were pretenders to Congress!

I HATE being scooped. Being spooned is much more fun.

Anyway, I think that progressive should simply pay the family, and stop making weasel comments like
can continue to work with the Fisher family to reach a resolution
AFTER their advising the legal counsel of the criminal how to win the court case.

Why are they resisting paying. I assume they have some legal grounds for not wanting to pay otherwise it would seem like a fools errand.

I can prove this one way or the other, however, knowing the gutter trash that the insurance companies are ( through personal experience), I feel the insured ALWAYS get screwed.

Nice long story on the subject in the Friday New York Times.

No they are just being a sleazy insurance company like State Farm was with hurricane Katrina victims.
