we watched radiohead on snl the other night. pretty damn good performance.
they played the national anthem and idioteque.

BTW... that flash was something else. A new artform in my opinion. And a worthy one.

Something tells me sharing pisspoor rips for free of a fraction of broadcast of a television show that is in syndication falls under "fair use."

Could be wrong.

I dunno. I'm pretty sure SNL owns the rights to everything it broadcasts. Just like you can't tape and redistribute any other TV show.

Section 107 provides in part: Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:
(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
(4) the effect of the use upon the potential market for or value of the copyrighted work.

1) non-profit use
2) not a perfect reproduction
3) a fraction of the copyrighted work as a whole
4) if there existed a market for fractions of clips in MPG format, they would be sold. If this were an item produced by NBC to be sold on the net, and it were being distributed for free... they would have a beef under #4.

Fair use is a neat thing. Lets you photocopy pages from books and everything. Ever noticed how most libraries have photocopy machines easily available.
