Go here for an excellent explaination about the woman being burned by the coffee, remember ALL she wanted was to have McD pay her medical bills for her 3rd degree burns.

Just to clear up something here. (I always post this when somebody mentions the McDonald's coffee case...) McDonald's was (for some reason nobody could figure out) intentionally (as per company policy) brewing thier coffee 20-50 degrees hotter than anybody else; so hot, that it was clearly hazardous. They knew about the problem and had been sued before, but did nothing. The woman who spilled it was a passenger, and the car was not moving. She suffered THIRD DEGREE burns due to the extreme temperture of the coffee. She originally asked for medical expenses only, McDonald's refused. The original huge judgement was reduced on appeal and was later settled for an unknown amount. In this case, despite what Jay Leno et al says, McDonald's was clearly at fault for providing a hazardous product. |

McDonalds lied. Period. The "hindu and other groups " consider all animal life sacred. To them eating animal products is tantamount to canabalism. McDonalds decided that the Hindu religon "not worth considering" in thier policy of labeling meat products as "vegetarian"
Getting rich fast ?? I think not, divide over 1 BILLION ppl into 10 Million dollars what does that come to??
To make ROOT BEER follow these instructions:
(the "root" is the wintergreen extract and Vanilla extract by the way) http://www.greydragon.org/library/br...root_beer.html

What happens to a Hindu who unknowingly eats beef???
Do you really think MCD really lied lied lied. Or made a mistake mistake mistake. Was this intentional or not.
Just curious where does coffee lady's responsibility for treating hot coffee with respect come in. The fact that MCD mad hot coffee was one of the reasons I bought it there.
Point of contention, I thought 3rd degree burns required charing of the skin. boiling water can only leave blisters which I thought was second degree burns.
Can I sue bayliner because when I was working on the engine I leaned up against a 400 degree part of the muffler riser. That chared my skin too. They could have made it cooler if they put another water jacket right there where I could lean on it.
I would like to see special caps put on lawsuit 1 lawyers can recover no more than 100,000 plus costs from a suit. Secondly people can receive no more than 1 life salary or so figuring in 2% annual inflation and medical. Now to make the company sorry they did the evil deed I would allow the remaining money go into a fund to help people injured in simmular circumstances.
This would keep alot of the frivolous suits at a minimum. It should not be the lottery. |

| Yes I do. They wanted the profit and it didnt matter who the hurt to make the money. That is why McD's pays minimum wage. Quote:

| MdDonalds had recieved complaints about their coffee before(in fact the county prosecutors office wanted them fined but dropped the ccharges after the woman won her suit. Seemed that was enough punishment to MAKE McD reduce its coffee temperature. And remember all the woman wanted was for them to pay for her medical bills Quote:

| If her doctor says it was 3rd degree burns since he is a pro then she had 3rd degree burns. Quote:

| All piping within 8 feet of the deck is required to have insulation on it. Maritime law. If someone doesnt have it they are in derilection of the law(used to be a sailor). As such the may be fined, or sued either way they were better off folowing the law in the first place. Quote:

| I disagree. The caps on paying the lawyers YES . BUT the corporations must be held liable for thier actions. The BEST way to do that is when they do wrong HIT THEM IN THIER WALLET!! Quote:

| NEITHER of these lawsuits are frivolous in my opinion. |

my scenario had a clause to punish the company.
"Now to make the company sorry they did the evil deed I would allow the remaining money go into a fund to help people injured in simmular circumstances. "
It just kept the greed of the person at bay. As they will receive none of the proceeds that would exceed lifetime income. They could still sue for more but they will not receive the proceeds that would go to charities or some like. Lets say you sue for 100,000,000. and your life time earnings would be about 3 million. the lawyer gets his capped amount. that leaves like $96,900,000 for the charity of your choice...
The cap can be set anywhere but I think % of likely life time earnings + medical would be the most fair.
I just do not believe that any individual deserves these multi million dollar settlements. The money does not directly come form the company. In that they make it up somewhere. Either the end user or throught the employees. Either way your victimless payout hurts people. |

hmmmmmm.. cap lawsuits at life salary... Interesting...
But say company A does something stupid causing me to lose the sight in both my eyes... I lose my potential to be an engineer for the rest of my life... so they pay me my life salary. But what about my vision??? If it is capped how will they ever reimburse me for a sunset? Well regardless, they wouldn't be able to... Who can put a price on vision, or legs, or hands etc. You can't. But something had better be done to remind comapny A they need to change. |
