Hey guys, one of my dad's friends has this site: http://justaskjoe.net/default.asp
And I see at the bottom that it is copyrighted to www.ainspect.com
My dad's friend is quite happy with the site, but they charge a horrible fee of $60/month. So I was going to look into building something of my own for him. One question about it though, if it's copyrighted to ainspect.com what would I be allowed to copy over to his new site if I do build one?
If I could just access the FTP and phpMyAdmin(if they use mySQL and have it setup) and it was legal to use all of his current stuff, I could just copy everything and set him up exactly as it is now with very little work, and he would only have to pay $5/month depending on bandwidth for hosting instead of $60. |

I guess the question is, What is copyrighted? The text? The graphics? You cannot copyright layout and colors or format. Is the copyrighted material the property of some parent trade organization? Then they should already have permission to use it.
Whatever about the site and its information are the property of the business, not the host, then you can feel free to copy it. |

Ya, I can't find out any info about what is copyrighted. I don't know about the text, there are some pages that look like they are used on every website they make, and come with the templates.
What would be the best way to find out what is copyrighted and what isn't? Should I just send the host an email(I don't want to mention his site though) and ask what information they hold copyrights on and what information the business owner has copyrights on? |

Yes, that would be the most straightforward approach. You could tell them you're a web designer with a potential client, which is perfectly true, and you want to know what information is not copyrighted, without providing any more details than that. |

The copyright information in question refers to all of the content not supplied by the client, the asp coding, the website template, any graphics not supplied by the client, the newsletters and the web form. Your father's friend has a signed agreement outlining what he's entitled to upon cancellation.
The $60 fee that you speak of is not just for hosting, it is for ongoing Search Engine Optimization, report uploads, webmail, bulk marketing program, use of our prewritten content, monthly managed updates, and other discount services.
The templates created by us are just a building block, we also customize the site to suit each clients needs, and the templates contain our own coding and it is protected. Copying and pasting this to another server would be considered theft of services, and Ainspect will take appropriate actions.
As you have noted your father's friend is quite happy with our services, and if he has a problem please have him contact us.

Yes, I saw that you gave them a bunch of things for $60, but $60/month is still a lot of money. I could set something up for $5/month or less, though it wouldn't have any of the SEO's(I haven't gotten into SEO yet), bulk marketing(I don't know what that is, but I am guessing you try and market his info wherever you can), or any of your extra content. The other stuff is easy enough to setup with php/html.
Oh, don't worry, if I would want something like that I would code it myself, stealing other people's work is horrible(I would hate to have my hard work stolen if I charged for it).
Thanks for the info, I might ask him if he would want to stay with you or not, but I am guessing he will.  |

yikes.. I am in the wrong business. That site looks amateurish at best.
