Lawsuit Alleges Xbox Burnt Down House

Texas couple Bryan Weatherford and Kimberly Weatherford are suing Microsoft over claims a defective Xbox console gaming system resulted in the burning down of their residence. The case could have merit, as Microsoft did eventually recall about 14 million Xbox power cords due to a faulty design.

"The pyrotechnic propensity of the product rendered it defective, unreasonably dangerous, and in breach of the defendant's express and implied warranties of fitness and merchantability," they claimed. Microsoft "was negligent" in the design and marketing of the Xbox and in its failure to recall the units. They claim the Vole failed to recall all Xboxes on first learning of the defective design and the likelihood of household fires.

Well when I couldn't get past a certain part in the game but there were no save points, I'd just leave my PS2 on until the next day. Rating: 5/5

I suppose if the fire marshall decided to investigate, they could potentially trace the fire back to an Xbox. Without a fire department investigation, it would be a lot harder.

But it looks like overheating machines are nothing new to Microsoft. I'm tracking the latest on the Xbox 360 at http://www.xboxoverheating.com.

Apparently, the Xbox overheats and crashes, and some guy in Chicago is suing over all of it. I don't know what kind of lawsuit you can file because your Xbox freezes, but it makes good headlines! IMHO, just take it back to the store you got it from and tell them it's broke. Go back to your original Xbox or PS2 and play that until they fix it.

Either that or prop it up on bricks to keep it cool...
